These Terms and Conditions (“Terms”) constitute a legally binding agreement between House of Fika (“Company/We/Us/Our”) and the user (“Customer/You/Your”) governing the use of the website ______________ (“Website”), and the purchase of products therefrom.

By accessing, browsing, or using this Website, You, agree to be bound by these Terms, including the policies referenced herein.

 

DEFINITIONS

  1. “Customer” means any natural or legal person who accesses, browses, or places an order on the Website.

  2. “Products” mean apparel, clothing, accessories, and any other merchandise offered for sale on the Website.

  3. “Policies” include the Privacy Policy, Return & Refund Policy, and Shipping & Payments Policy which form an integral part of these Terms.

 

ELIGIBILITY

  1. Use of the Website is restricted to persons who are competent to contract as per Section 11 of the Indian Contract Act, 1872.

  2. If you are under 18 years of age, you, may use the Website only with the involvement of a parent/guardian.

 

ACCOUNT REGISTRATION

  2. The Customer shall provide true, accurate, and complete information and shall update such information from time to time.

  3. The Customer shall be responsible for maintaining confidentiality of login credentials and all activities conducted under their account.

 

ORDERS AND ACCEPTANCE

  1. All orders placed on the Website shall constitute an offer to purchase the Products.

  2. Acceptance of such an order shall occur only upon dispatch of the Product(s).

  3. House of Fika reserves the right to refuse or cancel an order at its discretion, including but not limited to unavailability of Products, pricing errors, or fraudulent activity.

 

PRICING AND PAYMENT

  1. Prices displayed on the Website are in Indian Rupees (INR) and inclusive of applicable taxes, unless stated otherwise.

  2. Payment may be made through UPI, Wallets, or any other RBI-approved mode of payment.

  3. Cash on Delivery (COD) may be available at select pin codes and may attract an additional and advance fee.

 

SHIPPING AND DELIVERY

  1. Orders shall be shipped in accordance with our Shipping & Payments Policy.

  2. Estimated delivery timelines are indicative and subject to logistics constraints.

  3. Risk of loss and title shall pass to the Customer upon delivery.

 

RETURNS, REFUNDS, AND EXCHANGES

All returns, refunds, and exchanges shall be governed by our Return & Refund Policy, which forms part of these Terms.

 

PRIVACY AND DATA PROTECTION

  1. The collection, use, and disclosure of personal information shall be governed by our Privacy Policy.

  2. By using the Website, you, consent to such collection and processing as per applicable Indian laws, including the Information Technology Act, 2000.

 

CUSTOMER OBLIGATIONS

The Customer agrees:

  1. Not to misuse the Website for fraudulent or unlawful purposes;

  2. Not to copy, distribute, or exploit any content on the Website without prior written consent;

  3. To comply with all applicable laws including the Consumer Protection Act, 2019, the Legal Metrology (Packaged Commodities) Rules, 2011, and the Consumer Protection (E-commerce) Rules, 2020.

 

INTELLECTUAL PROPERTY

  1. All intellectual property rights in the Website, including logos, designs, product images, and content, are owned by or licensed to House of Fika.

  2. No Customer shall reproduce, modify, or use such intellectual property without express prior written consent.

 

LIMITATION OF LIABILITY

  1. House of Fika shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Website or Products.

  2. Our liability in respect of any order shall not exceed the purchase price of the Product in question.

 

INDEMNITY

The Customer agrees to indemnify and hold harmless House of Fika, its directors, employees, and agents from any claims, damages, liabilities, or expenses arising from breach of these Terms or misuse of the Website.

 

FORCE MAJEURE

House of Fika shall not be liable for delays or failure in performance caused by events beyond its reasonable control, including natural disasters, strikes, government restrictions, or logistics disruptions.

 

GOVERNING LAW AND JURISDICTION

  1. These Terms shall be governed by and construed in accordance with the laws of India.

  2. Any disputes shall be subject to the exclusive jurisdiction of the competent courts at Gurgaon, Haryana, India.
